Tomb Spiders and assault.

A friend of mine who plays Necrons tried to assault me with a tomb spyder last night after the spyder used its artificer power to make a scarab. I told him "no, its either make a scarab or assault" but he insists he is allowed. In the codex it says you can poop a scarab if the spyder is not in assault at the start of the assault phase. Since it doesn't say "You may not assault after the scarab is created" he thinks this is allowed. I told him it isnt, and what he is trying to do is complete rule twisting. All he could come up with in return is "SHOW ME WHERE IT SAYS I CAN'T ASSAULT" So I told him to try it in the Rouge Trader we are going to in a couple weeks and watch the judges tell him he can't do that. I'm not off my rocker with this one am I?

Your friend is right. The new Scarab is placed at the START of the Assault phase so it is not in close combat until it moves into CC per the rules.

Off hand I think I'd be inclined to agree, they can make a scarab and then assault, simply because of the way the rule is worded. I'm not sure I like the implication of this but I don't see much room to argue the point.

I think it means it can't make them while fighting. Noth that he can't make them before the fight. If you were right then he couldn't make one if you were going to assault him.

Well I agree the way it is worded makes it sound like you might be able to. It just seems to me that instead of fighting, it is spending the assault phase making the scarab swarm. So by the strict wording of the rules I suppose he could, it just seems like a stretch when it comes to common sense to me.

Beast-I don't understand how your comment makes sense. He can't make scarabs on my turn anyhow.

I have no problems with being proven wrong. If I'm wrong than I am. I have just never liked "It doesnt say you can't" as a reason, when sense leads you in a different direction. But in this case "It doesn't say you can't" just may turn out to be the popular opinion? I guess I should be used to this thing by now with Warhammer.

Yeah, the scarab can be pooped out because it's the start of the turn.
