hey all,
saw something interesting the other day when i was at the casino with some good friends, we bumped into some guys we used to go to school with and one of them was wearing a t-shirt that caught my attention. THis is why: It was bright green for starters, but smack bang in the middle of this t shirt was the imperial aquilla in all its glory, perfect in detail down to the one eyed heads and so on. Now this t shirt had south jive or something like that written across the top of the chest in 70's disco looking writing which really didnt fit but anyway. It wasnt a home made shirt as it had the south jive (what ever that is) tagged across the back so i guess it is a brand or something but my researching the net has come up with nothing. Was wondering if anyone else had seen something like this or knew the company, i just think that GW would crack down on this especially as it looks so out of place and really crap overall.

Copyright-breaking t-shirts are pretty common. I doubt this guys t-shirt will come onto GW’s radar.

Yeah, the "imperial Aquila" is a rip-off mash-up of the WWI Austro-Hungarian double-headed eagle with the the WWII Nazi insignia.

I doubt GW would have much luck pushing for copyright infringement on the basis of that design alone.

If the words "Warhammer" or some similar trademark had been infringed then they would have done something, but taking an artistic image and mashing it into a different context is pretty much anyone's definition of "fair use", even if itself it wasn't something derived from others' artwork in the first place.

I doubt GW will bat an eyelid.

Possibly, but not in the Games Workshop style. It sounds like the T-Shirt Cherubael mentioned is an exact copy of the GW aquilla symbol.

yes it was the aquila, an exact copy as i said down to the one eye and the right number of stylised feathers on each wing. It is the same as the gw one period.
As for bombot, ask on here about some of the small things GW has gone after in the past and then think about a clothing company using their IP on t shirts...
And yes they do own the aquila, been through this a million times even though they "stole" it from other sources.
(wish i had posted something else for my 1000th post but feth it...)

If it's being mass-produced, then it may be worth GWs while for them to go after.

If it's some bloke in a garage printing them out for his mates, then they might just send out a sternly worded cease and desist.

yeah i know but this wasnt a garage job, seemed to be a pretty good quality t and there were all the signs of company branding on it.

No sign of any companies called South Jive. I found a T-shirt company called FreshJive, but i couldn't find anything that could be construed as an aquilla on their stuff...

Target have been selling these in Oz for a while now, and yes GW do know about it, so Im guessing the legal boys are working out the best thing to do.

Well the problem with large corporations and trying to sue them is they are already paying thier lawyers so they can drag things out if they like.

The aquila is a trademark of GW..

No doubt someone will correct me if I am wrong, but all GW will have to do is get an injunction against the company to stop them making the t-shirts, and this is something relatively easy to do.

Hmmm. Was the Aquila on an angle? If so I believe I saw Edge (WWE wrestler) wearing one during a show. I didn't get a great look at it but I thought I definately saw the Imperial Aquila splayed accross the front.

Either way, I'm buying one!

For a split second I thought my eyes had decieved me as there's no way 'Edge' would be into Warhammer, right?

But i looked again and there it was!

Makes sense now though:D

I think its pretty unlikely GW will bother firstly the cost of tracking whoevers doing it and stopping them v.expensive and the likelyhood of any gain out of it probably unlikely.
Also I don't think the aquilla is copyrighted as like other posters have mentioned it is an ancient symbol with lots of different meanings

As others have mentioned, the aquila is a copyrighted/trademarked gw symbol.

As such, they have to take proactive steps to prevents its unauthorised use, else they lose the rights to it.

Exactly. A two headed eagle may be an ancient one, and it's use can't be copyrighted. but GW designed it's aquilla symbol, which can be copyrighted.

ok so the aquilla is copyrighted I still think they'd have a hard time proving that it was a copy of the aquilla etc.. and I still feel that the effort it would take to stop them verses the gain doesn't make it worth it. But then I do have quite a jaded view of the legal system :)

If the shirts are made in china or russia or a couple of other places, there is pretty much nothing they can do about it at all.

I must say this kind of behaviour saddens me, its very painful to see people so brainwashed or innocent that they do the dirty work for large corporations. Don't any off you know what the word corporation means or what they are.

A corporation is legally only interested in one thing they must try to make as much profit as possible my any means even if its means breaking the law if the fines for doing so work out cheaper.

You may like the product and you may even like the nice person who is selling it to you but be don't be fooled they only like your money and your ability to spread memes.

Corporations are bad ok don't be a puppet.

Target is a huge store infact it is the one chain Wal Mart believes to be thier major competitor. Regardless of the right or wrong of the issue I suspect that the shirts are made over seas and not by target themselves so even if they win a case proving copyright infringement probably all that would happen is Target would say 'Oh sorry we will cancel that contract then.' If it even went that far. And if rumors are true about GW's finacial health they may have to pick and choose thier fights with a little more care than one might think.


But then again I am no legal expert and Target might just decide to get into a pissing comtest with the much smaller company.

Um....Target eats companies the size of GW for lunch. I almost hope the suits at GW HQ try to play with Target. It is a little like free advertizing for GW;)

I've seen the shirt too, on sale in Macy's. It's a 100% accurate reproduction of the GW aquilla, albeit festooned with dodgy rhinestones! Came as quite a surprise to stumble across it.
